Portal Terms of Use

Access to THE WEBSITE confers the condition of USER and implies full and unreserved acceptance of all the conditions set forth in this LEGAL NOTICE. These conditions are intended to regulate both the provision of information and the possible business relationships, if any, arising between HELLOMRLEAD and users of THE WEBSITE.

If the USER decides to use any of the services managed by THE WEBSITE, he/she must expressly and previously accept all the terms and conditions included in this LEGAL NOTICE and in the PRIVACY and COOKIES policies. Therefore, if the USER does not agree with each and every one of the established conditions, he/she must refrain from using THE WEBSITE.

There are conditions within this LEGAL NOTICE that refer to the use of a particular service, and affect only and exclusively to the relationship established between HELLOMRLEAD and the USERS of such services, not affecting the rest of the USERS of the WEBSITE that are not registered in them. The fact of accepting the conditions of service at the time of formalizing the USER’s registration does not imply the assumption of any obligation at that moment. These obligations shall not come into effect until the USER actually decides to use the service offered on THE WEBSITE or by means of the cross-checking of information carried out electronically with HELLOMRLEAD.

HELLOMRLEAD reserves the right to modify or update all or part of the contents of this LEGAL NOTICE, taking into account any changes in applicable laws and regulations. Each new version of the LEGAL NOTICE shall be effective as of the date of its publication on THE WEBSITE. The USER must review its content each time he/she accesses it. If the USER does not agree with any change that may occur, please do not use THE WEBSITE.

Electronic links to THE WEBSITE are permitted provided that they do not alter, falsify, limit or modify in any way the content or presentation of the pages that make up THE WEBSITE as designed by HELLOMRLEAD.

HELLOMRLEAD assumes no responsibility for the content of third party websites to which THE WEBSITE establishes links. If at any time there is evidence of the unlawfulness of all or part of its content, the link established to that website will be automatically removed.

Responsibility of HELLOMRLEAD

HELLOMRLEAD shall be liable for any damages that the USER may suffer as a result of the use of THE WEBSITE, provided that such damages are directly attributable to an intentional or negligent action of HELLOMRLEAD, and the USER’s actions were not due to fault or negligence. In any case, there shall be no fraudulent or negligent action on the part of HELLOMRLEAD when it proves that it has complied with the legally established demands and requirements and the other care and diligence required by the nature of the service provided.

The services of the information society offered on THE WEBSITE and not subject to prior contracting are provided to the USER without the requirement of any consideration whatsoever. They only entail for the USER the obligation to comply with the rules of use set forth in this LEGAL NOTICE. HELLOMRLEAD does not undertake, therefore, to comply with certain levels of availability of THE WEBSITE or to adopt specific security measures. Likewise, HELLOMRLEAD may suspend, withdraw or cancel partially or totally the services not subject to contracting at any time and without prior notice. In the event of such cancellation, it shall not affect the services that have been previously contracted, which shall continue their course as agreed with said USERS.

The Internet connection required to access THE WEBSITE is in no case provided by HELLOMRLEAD, being the responsibility of the USER. The USER is informed that communications through open networks are not secure. It is the responsibility of the USER to take all appropriate technical measures to reasonably control these risks and prevent damage to their equipment, loss of data or theft of confidential information. For this purpose, it is recommended to have updated malware detection systems, as well as updated security patches of the browser you use to access THE WEBSITE.

Obligations of the USER

In general, the USER is obliged to comply with the conditions set forth in this LEGAL NOTICE, as well as, where appropriate, the specific conditions that apply to the services or products requested through THE WEBSITE. Likewise, the USER undertakes to act in accordance with the law, good customs and the requirements of good faith, using the diligence appropriate to the nature of the service enjoyed, refraining from using THE WEBSITE in any way that may prevent, damage or impair the normal operation of the same, the property or rights of HELLOMRLEAD, its suppliers, other users or, in general, any third party.

In particular, and without this implying any restriction to the obligations assumed by the USER in general established in the previous section, the USER undertakes in its use of THE WEBSITE, as well as in the provision of services managed through the same, to:

Not to enter, store or disseminate on or from THE WEBSITE, any information or material that is defamatory, libelous, obscene, threatening, xenophobic, incites violence, discrimination based on race, sex, ideology, religion or in any way violates morality, public order, fundamental rights, public freedoms, honor, privacy or the image of others.

Not to introduce, store or disseminate through THE WEBSITE any software, data, virus, code, or any other electronic or physical instrument or device that may cause damage to THE WEBSITE, to any of the services managed, or to any of the equipment, systems or networks of HELLOMRLEAD, of any user, of HELLOMRLEAD’s suppliers, or, in general, of any third party.

4.- Not to carry out advertising, promotional or commercial exploitation activities through THE WEBSITE, nor to use the contents or information obtained through the same to send advertising, send messages for direct sales purposes or for any other commercial purpose.

Not to use false identities or impersonate the identity of others in the use of THE WEBSITE, or in the use of any of the services offered therein, including the use of passwords or access codes of other users.

Not to use, destroy, alter, disable or damage the data, information, programs or electronic documents of HELLOMRLEAD, its suppliers or third parties.

7.- Not to introduce, store or disseminate through THE WEBSITE any content that infringes intellectual or industrial property rights or intimate, personal or confidential information of third parties, or in general, any data of which it does not hold, in accordance with current legislation, the right to make it available to a third party.

Communications

For any necessary communication between HELLOMRLEAD and the USERS, the latter should contact us by e-mail to [email protected], or by traditional mail to HELLOMRLEAD, Av. Diagonal, 263, 08013 – Barcelona (Spain).

HELLOMRLEAD informs the USER that for the computation of all deadlines specified in working days within THE WEBSITE will be excluded Saturdays and Sundays, national holidays, as well as local holidays that are set annually for the town of Barcelona (Spain).

Communications from HELLOMRLEAD to the USER will be made in accordance with the data provided by the USER when registering on THE WEBSITE, or where appropriate, by the address stated in the last written communication sent by the USER.

The USER expressly accepts and for all communications related to the use of THE WEBSITE, and/or the contracting of the services offered therein, the use of e-mail as a valid procedure for the remission of such communications. It also accepts as a valid means of communication the advertisements posted directly on THE WEBSITE.

Intellectual and industrial property and image rights.

All the contents present on THE WEBSITE, designs, texts, images, photographs, videos, logos, source codes, the selection and form of presentation of the materials included therein, as well as its structure and design, are subject to the intellectual and/or industrial property rights belonging to the owner of THE WEBSITE, or their use has been authorized with limitations by their owners, and therefore the total or partial reproduction, public communication, modification, transformation, copying, distribution, or any other form of exploitation and manipulation of said elements is strictly prohibited. No USER may carry out these actions without the prior written authorization of HELLOMRLEAD and, where appropriate, of the holders of such rights.

Likewise, all photographs and videos appearing on THE WEBSITE are protected by the image rights of the owners appearing in them. HELLOMRLEAD has only obtained your authorization for publication on THE WEBSITE, so it is strictly forbidden to copy these images, unless expressly authorized in writing by the owners of these and HELLOMRLEAD.

Disclaimer of Liability.

HELLOMRLEAD is not responsible for the misuse that the USER makes of the contents of THE WEBSITE, reserving the right to update, modify, preserve, delete, or prevent access to any content that appears on it, or to close it without notice.

HELLOMRLEAD shall not be liable for any damages that may arise from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system, caused by external causes; delays or blockages in the use of this electronic system caused by deficiencies or overloading of telephone lines, the Internet system or other electronic systems, as well as damage that may be caused by third parties through illegal interference beyond the control of HELLOMRLEAD.

HELLOMRLEAD shall not be liable for infringements committed by the USER that infringe the rights of another user of THE WEBSITE or third parties, affecting copyright, trademarks, patents, confidential information and any other industrial or intellectual property rights.

Applicable legislation

The relations established between HELLOMRLEAD and the USER through THE WEBSITE shall be subject to Spanish law, except in those cases in which, as a consumer, other more advantageous provisions are applicable to the USER. This contract has been drawn up in Spanish and shall be the only language in which electronic contracting may be formalized, although for ease of understanding it may be presented in other languages for information purposes only.
